Call for tender 141/PP/ENT/ADM/12/6363 - study evaluating the status quo and the legal implications of third party liability for the European security industry.
The Directorate-General for Enterprise and Industry (DG ENTR) is responsible for security research in the 7th EU framework programme (FP7) and in this regard also deals with issues that have the potential to seriously influence the innovation cycle 'from research to market'. If not addressed correctly such influences may lead to significant gaps in the cycle thereby impeding innovation. Third party liability for security industry products and services has been identified as an issue potentially leading to a market gap. The main objective of this study is threefold: 1. to collect, analyse and assess data from various legal sources and actual best practices related to the field of third party liability; 2. to provide, based on the results of point 1, a comprehensive overview on the current status of third party liability related legal implications for the security industry as well as a portfolio of feasible policy options for the Commission to address these implications effectively; 3. to present these results in an easily accessible and comprehensible way taking into account from the beginning of the study that the findings and their respective reasoning will present the potential basis for wide ranging policy decisions by the European Commission thus should equally allow laymen as well as legal experts to use the respective findings to the full extent. Maximum value of the contract: 800 000 EUR
