Multiple Mixed Framework Contract for the Provision of Expert Consultancy Services and Studies in the Context of Investigations and Enforcement Related to Foreign Subsidies
The subject matter of the FWC is expert consultancy services and reports in the context of the enforcement of the Foreign Subsidies Regulation. External expertise is sought to support DG Competition’s enforcement of the Foreign Subsidies Regulation in order to receive detailed reports on the impact of subsidies in given sectors, on the benefits of financial contributions, on the distortions caused by foreign subsidies, and on any potentially positive effects of foreign subsidies.The purpose of this call for tenders is to conclude multiple framework contracts with up to four contractors per lot in order to provide the contracting authority with the provision of services. Given the different nature of the requested services, the services have been divided into two lots:1. market intelligence; and2. case support.

Market Intelligence
The contracting authority will need to collect detailed and substantiated information about foreign subsidies granted at various levels of governments (e.g., central, provincial, local) for various economic activities falling under the FSR, in particular those benefitting an undertaking, which engages in an economic activity in the Union. The subsidies may in principle concern all economic sectors.The contractor is expected to provide expert consultancy services and studies in relation to the existence and impact of foreign subsidies across the EU economy. This will include gathering general market intelligence and data on foreign subsidies and their potential distortive effects, and providing analysis on the impact of subsidies in given sectors, based on both public and commercially available data including, but not limited to, an analysis of financial statements of companies, information and practices by public and private entities, whose actions may be attributed to a third country.

Case Support
The contractor is expected to provide support in the context of individual enforcement cases, including information gathering, and carrying out analyses such as assessing the benefit of a financial contribution, assessing distortions caused by subsidies and assessing any potential positive effects of foreign subsidies. In order to carry out the tasks in lot 2, the contractor should have the capability to rely on experts with the necessary linguistic skills when undertaking market research on third countries, including, but not limited to, the most widely spoken third country languages (e.g., Chinese, Arabic, Russian). This may be done by subcontracting these tasks.
