Study on Emerging Issues on Collective Licensing Practices in the Digital Environment — SMART 2018/0069
Description
The objective of this study would be:1) To assess the effectiveness of different forms of management of rights in light of technological changes/online uses;2) To examine the development of multiteritorial licensing in the music sector as regulated by the CRM Directive (including the number of CMOs compliant with the requirements of the CRM Directive on multi-territorial licensing, the functioning of licensing hubs, the representation agreements in this area between CMOs, the proportion of repertoire available under multi-territorial licences, etc.);3) To examine how collective licensing practices such as ECL or mandatory collective management are used in the different MS; and4) To assess to what extent collective licensing practices facilitate the licensing of copyright protected content, especially for online uses, or on the other hand constitute a challenge both from a legal and economic perspective.
