Future Electronic Communications Product and Service Markets Subject to Ex Ante Regulation (Recommendation on Relevant Markets) — SMART 2018/0082
The appropriate identification of relevant markets susceptible to ex ante regulation at EU level is a key to the overall functioning of the EU Regulatory Framework. Article 64(1) of the new European Electronic Communications Code sets out a legal requirement to review the current Recommendation within 2 years of the date of entry into force of the code. This study should provide a structured quantitative and qualitative analysis of EU electronic communications markets to allow the commission to ascertain:(i) whether the current boundaries of the relevant markets have to be adjusted;(ii) whether all the markets in the current recommendation (whether or not with adjusted boundaries) still warrant ex ante regulation or whether regulation should be withdrawn; and(iii) whether any new markets which warrant ex ante regulation can be identified. Moreover, the impact of altering the list of relevant markets should be assessed against the key policy objectives identified in Art. 3 of the Code.
