Otsikko	Study supporting the drafting of model contractual clauses under the Data Governance Act on the reuse outside the EU of protected data held by the public sector
Kuvaus	Please note that this is not a call for tenders but a publication announcing the Contracting authority’s intention to publish a future negotiated low or middle valueprocedure. Chapter II of the Data Governance Act regulates the reuse of protected, publicly held data. Under Article 5(11), the Commission is mandated to develop model contractual clauses that public sector bodies may use when allowing the reuse of such data outside the EU. This includes data that originally contained commercially sensitive information, such as trade secrets or IP, but that have been modified for the purposes of the reuse or that were permitted to be accessed in a secure processing environment controlled by a public sector body. The Commission may propose a set of such model contractual clauses by way of an implementing act. This study will support the development of those model contractual clauses. By bringing their technical and legal expertise on the reuse of non-personal, protected data held in public registers, the contractor will compile a comprehensive set of clauses currently used and will assess their impact on the reuse of such data outside the EU. The contractor will also identify and analyse the risks resulting from the reuse. Based on the above, the contractor will draft a set of contractual clauses that public sector bodies may rely on when granting access to data for reuse outside the EU. --- Estimated total maximum value (EUR): € 40,000 --- Maximum contract duration: 4 months
