Applicable Law
Regarding item I.12 and II.6 of the draft framework service contract we ask for clarification: we assume Austrian Law is applicable and liablity of the contractor is fault-based. Please confirm.

Please note that the European Union Agency for Fundamental Rights is a European Union body and its procurement is governed by Regulation (EU, Euratom) 2018/1046 on the financial rules applicable to the general budget of the Union, available at: https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A32018R1046 The financial rules governing procurement procedures are available in Title V of the above-mentioned Regulation. As set out in Article 1.12.1 of the Special Conditions in the draft framework contract (FWC) the FWC is governed by Union law and, where necessary, complemented by the law of Austria. Article II.6 of the General Conditions of the FWC refers to the situations under which the contractor and/or its partner(s) and/or its subcontractor(s) is/are liable for any damage or loss caused by the contractor (partner(s) / subcontractor(s)) during or as a consequence of implementation of the FWC.
