Are non-EU (sub)contractors eligible to be pre-listed?

A company based in a non-EU member state is generally not eligible. This procurement procedure is not covered by the WTO Agreement on Government Procurement (GPA). Europol may nevertheless exceptionally accept participation in a particular procurement procedure without creating a precedent or obligation for the future. The ad hoc acceptance is very rare and must be adequately justified by the Europol Authorising Officer (for example if there are no other economic operators from within the EU offering the requested services). Regarding subcontracting to a company based outside of the EU please note that Europol cannot limit subcontracting, economic operators are free to choose their subcontractors from any country.
