An amended version of the tender specifications will be published with the following changes: 1.The first paragraph of point 2.1 has been almost completely deleted. The published draft service contract had already been updated in line with the changes to the Financial Regulation; 2.The date of entry into force and the expected date of signature have been changed; 3.Erroneous references to articles of the draft service contract have been corrected at pages 12, 13 and 41.

Joint Venture
We are bidding as a group of companies but would want to execute the contract in a new legal entity (“Newco”). Do we have to found Newco now and use it already for bidding or can we do it after the contract has been awarded to the consortium?

Yes, you are allowed to submit the tender without formally creating the new legal entity. Please note however that Commission reserves its right to require a consortium to adopt a given legal form before the contract is signed if this change is necessary for proper performance of the contract. Also, grouping of firms must nominate one party to be responsible for the receipt and processing of payments for members of the grouping, for managing the service administration, and for coordination. The documents required and listed in the call specifications must be supplied by every member of the grouping, the checklist in Annex 6.6 will help verifying the level of information to be provided according to the role of each entity in the tender. Each member of the grouping assumes a joint and several liability towards the Commission. The offer has to be signed by all members of the group. However, if the members of the group so desire they may grant an authorisation to one of the members of the grouping. In this case they should attach to the offer a power of attorney (see model in Annex 6.5). For groupings not having formed a common legal entity, model 1 should be used, and for groupings with a legal entity in place model 2.
