Conflict with H2020
2. According to the tender specifications (paragraph 3.1) : “the objective of this multiple Framework Contract is to provide the Energy Directorate of the Directorate-General for Research and Innovation, with external expertise of high quality to ensure objectivity and high-level technical service to support the Directorate in the design and preparation of Union policy initiatives and legislative and programme proposals in the field of non-nuclear energy research and innovation, in particular Renewables, CCS and Clean Coal. The required services are in the areas of policy and technical analysis and will be delivered in the form of studies”. This means that the consortium may be involved in a service - under the present Framework Contract - aiming at supporting the Energy Directorate in the design and preparation of a programme proposal in the field of non-nuclear energy. Being H2020 the main programme in which research and innovation activities are funded, may the award of this Framework Contract affect the possibility of the consortium partners to apply for calls for proposals launched under the framework of H2020?

The required services are in the areas of policy and technical analysis and will be delivered in the form of studies. The selected tenderer will be asked to provide specific studies will be used as support materials by the EC for EC activities, which could be in relation to legislative and also programme proposals, but the tenderer will not be asked to prepare a programme proposal. There is no ground to prevent a contractor from participating in a call for proposals since the conflicts of interest are hypothetical and not real but the requirements concerning the conflicts of interest stated in article II.4 of the Framework contract shall be respected.
