Subcontractors in separate, competing consortia
Can the same legal entity participate as an identified subcontractor in two different consortia (i.e. led by different companies) competing for the same lot? Would it make any difference if the CV, project references, and peer reviewed publications contributing to the two competing consortia were different?

It depends: if the level of subcontracted activity of the subcontractor is small enough to consider it marginal yes, particularly in the case you mention where if the CV, project references, and peer reviewed publications contributed to the two competing consortia were different. On the contrary, in case this same subcontractor was the principal component of one or two of the tenderers, then both tenderers should be disqualified because it is forbidden to tender more than once.
