Annex VII - Draft contract
Article II.6.3 states that the contractor is liable for all damage. In our opinion however, liability for consequential damage cannot be regarded as a reasonable and proportional requirement. Are you prepared to adjust Article II.6.3 in the sense that Contractor can only be held liable for direct damage, unless there is intent or deliberate recklessness?
