Annex 5, Special Condition I.1.4
Clause I.1.4 of the Annex 5 (Draft Framework Service Contract) states that “the contract does not confer on the contractor any exclusive right to provide the service […] to the Agency.” Could you please explain in a bit more detail how this shall be interpreted, particularly whether this could mean a retendering or reopening of the competition at any later stage after contract award and signature?

Article I.1.4 of the draft framework contract should be interpreted as meaning that if during implementation of the contract the need arises for additional or supplementary services the EEA may decide to procure services from anther service provider than the future contractor.
