-3.7.2. Quality Criteria 2 and 3: case studies/simulated Request for Services -3.6. Technical and professional capacity criteria and evidence
- On page 25 of the Terms of Reference, the "Simulated Request for Services 1" lists two alternative option, namely a) Study supporting evaluation of Directive 2002/46/EC of the European Parliament and of the Council of 10 June 2002 on the approximation of the laws of Member States relating to food supplements; and b) Study supporting evaluation of EU seed marketing requirements (Directive 2010/60/EU; Directive 2009/145/EC; Directive 2008/62/EC and specific legislation). Do we understand correctly that tenderers are free to chose which of the two topics they select for the simulated request 1? - On page 21 of the Terms of Reference, you list under "Criterion A2: The tenderer must prove its capacity to work in all EU countries" the following required evidence: "Evidence A2: The tenderer must provide references for 5 projects (table 1) delivered in the last three years. The combination of projects must cover at least 15 EU countries. In addition, the tenderer must prove that it has contacts in the EU countries not covered by its project experience in order to ensure the required geographical coverage; for this purpose, the tenderer must provide letters of intent from the contact points." Do we understand correctly that a tenderer that provides project references of studies covering all 28 Member States (e.g. EU28 studies conducted under similar framework contracts) does NOT need to provide any additional information, such as the mentioned contact points.

Contact points must be provided for the EU countries which are not covered by the tenderer's project experience required under criterion A2. If the tenderer has evidence for experience covering all EU countries no further contact points need to be provided.
