Non-Disclosure Agreement Submission/Location of Document
We are working on our tender documentation for 16.CAT .OP .187. In the Specifications document we were sent with the invitation to tender it states on page 9 that a number of references are available for us to use in the development. In order to get these documents it states we are required to email this email address with a Non-Disclosure Agreement (NDA), to be found in the Annexes. However, in the Annexes it lists the NDA (if applicable) is found at Annex 4.8 and our pack only goes up to 4.7 Draft Contract (which is blank). We also do not have Annex 4.9 Security Information Sheet (but perhaps we do not require that in this case). Please can you advise if we do need to complete an NDA for this tender and if so where I can find it?

Tenderers shall disregard the following part of the answer provided on 26/10/16: “In accordance with paragraph 2.8 of the tendering Specifications, the overall level of classification of 16.CAT.OP.187 is "UNCLASSIFIED". It follows that Annex 4.9 Security Information Sheet is not relevant to this procurement procedure.” Section 2.8 of the Tendering Specifications is hereby amended as follows: 2.8. SECURITY STANDARDS In the general implementation of its activities and for the processing of tendering procedures in particular, EDA observes the Council’s security rules set out in Council Decision 2013/488/EU of 23 September 2013 on the security rules for protecting EU classified information. The overall classification of the present contract is RESTREINT UE/EU RESTRICTED. The overall classification of deliverables of the present contract shall not exceed RESTREINT UE/ EU RESTRICTED. For details about the elements of contract to which security classification is assigned refer to the draft contract, Appendix III (now provided in the Document Library), which may be revised by EDA during contract implementation. Several obligations for tenderers and the Contractor derive from this classification.

The model Non-Disclosure Agreement to request access to the documents referred to in paragraph 1.2.1 is now provided. In accordance with paragraph 2.8 of the tendering Specifications, the overall level of classification of 16.CAT.OP.187 is "UNCLASSIFIED". It follows that Annex 4.9 Security Information Sheet is not relevant to this procurement procedure.
