If a only one tender will be compliant with the tender specifications and therefore passes the selection criteria, will the Contracting Authority have to cancel the tender procedure? Can the contract be awarded if only one bidder can submit a compliant offer?

As indicated in the Tender documents – part 1- Administrative Annex "The contract shall be awarded to the tenderer ranked first, who is not in an exclusion situation, whose tender is compliant with the requirements of the Tender Specifications and who fulfils the selection criteria". This is valid also in the case only one compliant offer is received. See also point 10 and 11 of the invitation to tender which state: 10. This invitation to tender is in no way binding on the contracting authority. The contracting authority's contractual obligation commences only upon signature of the contract with the successful tenderer. 11. Up to the point of signature, the contracting authority may cancel the procurement procedure without the tenderers being entitled to claim any compensation. This decision must be substantiated and the tenderers notified.
