We are a global network of firms with Member Firms in the majority of the countries around the world. Based on the Contract Notice and the tender specifications we understand that a member firm based in a country that have ratified the GPA can participate to this tender, either e.g. by contributing to the technical and professional capacity or by participating as a member or leader of a consortium. More specifically, in the contract notice under point IV.1.8) Information about the Government Procurement Agreement (GPA), it is mentioned that the procurement is covered by the Government Procurement Agreement. In addition to that, in the Tender specifications, under point 3.2. ACCESS TO THE MARKET it is specified that where the Plurilateral Agreement on Government Procurement (GPA) concluded within the WTO applies, the contracts are also open to nationals of the countries that have ratified this Agreement, on the conditions laid down therein. Based on all the above elements, we understand that technical and professional capacity e.g. from an Australian or USA based firm can be accepted, and that legal entities from these countries can participate as members or leaders of a consortium. Can you please confirm our understanding?
