Draft FWC-Lot 2- Intellectual Property
Question
As a provider of legal advisory services bidding for Lot 2 (Legal and paralegal advice and assistance), we do not consider the elements of II.13 (Intellectual Property Rights) within the FWC, to be applicable to our services. Instead, our understanding is that this applies to the provision of other goods and services procured through this tender (e.g. Lot 1 Support to grants, programme and technical management). Please can we confirm our understanding is correct. In line with this, can we confirm that we are not required to establish and evidence our pre-existing intellectual property rights.

The Contracting Authority confirms that the provisions of Article II.13 of the draft FWC-LOT2 do not apply. Consequently, the Contracting Authority confirms that future contractor is not required to establish and evidence the pre-existing intellectual property rights.
