Conflict of interest / exclusion criteria
Dear HADEA, Can you please clarify if the conflict of interest / exclusion criteria in Annex 7, namely those in points a) and e), also cover services that are provided in the context of Article 15 Directive 2014/40/EU and its related implementing acts? We refer to services such as the ID Issuer, primary repositories and/or anti-tampering devices. Best regards,

As outlined in page 49 in submitting an offer, tenderers declare to have no conflict of interest in connection with the topic, in particular with regards to the provisions of Article 5.3 of the WHO Framework Convention on Tobacco Control (FCTC) and of the guidelines for its implementation (in particular paragraph 4.3); a conflict of interest could arise in particular as a result of economic interests, political or national affinities, family or emotional ties or any other relevant connection or shared interest. When filling in Annex 7 any service or situation that could potentially lead to a conflict of interest relevant to points a) to g) should be considered. More specifically, point e) of Annex 7 refers to any non-audit (e.g. consultancy) services in the fields of tobacco traceability or the fight against illicit trade of tobacco products.
