Acceptance of Draft Contract
Question
Our legal team has reviewed the Draft Contract and has some concerns with regards particularly to the liabilities that the Tenderer is responsible for if awarded the contract. We cannot find a way to submit any proposed changes or amendments to the contract. Can you please advise as to what we should do in the case that we do not accept terms of the contract and would like to instead propose alternative wordings?

There is a condition of tendering that the tenderer accepts the draft contract. Without such acceptance any tender shall be eliminated. EMA is not able to modify the draft contract at the request of a tenderer since that would depart from the principle of equal treatment of tenderers. Should a tenderer require any clarification on any contract term then such clarification can be provided, but this will not lead to any amendment of contract terms.
