Section 1.6.d of the tender specifications
Question
For this tender, we intend to make up a consortium with partners and subcontractors. We will be the lead contractor and our partners will provide a power of attorney authorizing us to sign the documents as joint tenderer. In this case, we understand that the leader and the partners have to provide the evidences requested in point 1.6.d (page 8 of the tender specifications) but that subcontractors (companies) do not need to provide these evidences. However, in point 5.1 – Annex 1, we see in the table regarding “evidence as regards legal and regulatory capacity (4.3.3)” that it is indicated “YES” in the column for the subcontractors. Could you please confirm that subcontractors don’t have to provide the evidences described in point 1.6.d (tender specifications) especially if the combined share of all subcontracting companies doesn’t exceed 50%.
