In clause II.1 of the EN Draft Contract we read the definition of 'Personnel' who are responsible for 'implementing' the FWC. It should be clarified that with respect to the FWC there is a distinction between the two types of personnel our company engages: corporate staff and Interim Personnel . This distinction is extremely important especially as the Interim Personnel is working under the supervision and management of Eurojust, whilst the corporate staff (personnel) is delivering the services. Are you therefore willing to add the following definitions to clause II.1: Interim Personnel means the worker employed by a Contractor who is temporarily assigned to Eurojust to work under the supervision, direction and control of Eurojust pursuant to an Assignment. Services means the selection and provision of Interim Personnels employed by Contractor to be assigned to Eurojust to work under the supervision, direction and control of Eurojust. For the avoidance of doubt, the Services do not include the work performed by a Interim Personnel during an Assignment at Eurojust. Assignment means the provision of an Interim Personnel by Contractor to Eurojust at the request of Eurojust, subject to this FWC. If not, why not?
