The allocation / potential increase of the fee threshold regarding member states having several different legal systems
Dear Sirs Could you please clarify if any additional fee threshold may be allocated per member state taking into account that some countries have more than one legal system effective. For instance, the United Kingdom has three legal systems i.e. (1) English law, which applies in England and Wales, (2) Northern Ireland law, which applies in Northern Ireland and (3) Scots law, which applies in Scotland. Therefore, in particular case the workload may be 3 times greater than in other countries Thus, do we understand it correctly that the fee with the threshold of EUR 54,000 shall be payable for all of the work done regarding all jurisdictions in one member state or alternatively, the aforesaid threshold could be increased with regards to number of the analysed legal systems (in the UK example increased 3 times up to EUR 162,000 in total)?

As explained in the Commission’s Call for tenders, the respective payments are foreseen to be made as per Member State and per Directive. One and the same approach applies to the analysis of each Member State’s legislation, irrespective of possible differences which may exist as regards their regional/federal structure. In addition, it should be taken into account that for analyses related to UK rules the threshold of € 54.000 would encompass only legal assessment since there will be no request for translation of national provisions. For other Member States, however, this threshold would cover both for legal assessment and translation cost.
