1. Awaiting a final text, is the European Commission considering the definition of 'importer' as defined in the European Commission proposal of 2014, or the later European Parliament amendments? 2. Will warehouses and customs agents also be considered importers even though never really responsible for the goods? 3. Can you confirm that it is correct to assume that the definition of importer includes both upstream and downstream importers and that it includes both EU and non-EU companies supplying to the EU?

Although the definition of the importer remains subject to the final legal text, the below definition should be used for the purpose of the study: 'Importer' means any natural or legal person declaring minerals or metals within the scope of this Regulation for release for free circulation within the meaning of Article 201 of Council Regulation (EU) No 952/2013 or the natural or legal person on whose behalf such declaration is made, as indicated in data element 3/15 and 3/16 according to the provisions laid down in Annex B of Delegated Regulation (EU)2015/2446.
