COMMENT: In your reply to question #91, you have confirmed that freelancers can sign letters of intent with more than one consortia. We believe this answer creates a “de facto” contradiction with the Annex 4.9, Section 6.2.2 Version 1. 1 (update of 01/03/2017) of the Tender Specifications that clearly states “An individual person can only be counted for one lot and one profile”. Cases of freelancers signing letters of intent with multiple companies, and therefore being included in multiple offers, will lead to instances of same freelancer individuals being included in both Lot 1 and Lot 2 (via different consortia). We believe this will be the case especially for the highly qualified and certified freelancers that meet the criteria of multiple profiles, like LOT 1: Security analyst (SecAn) and LOT 2: Information Security Manager (ISecM). In our view, this will limit the pool of experts to be evaluated by the Commission as part of the tender and therefore decrease the relevance of one important element of technical and professional capacity (experts who will deliver the work) within the evaluation process. Freelancers signing letters of intent with more than one consortia may lead to a situation when freelancers will be included in more than one lot and more than one profile, in breach of the Annex 4.9, Section 6.2.2 Version 1. 1 of the CASIS Tender Specifications. QUESTION: Could you please re-evaluate your answer to Question #91 and confirm that cases where freelancers can sign letters of intent with more than one consortia cannot be accepted?
