When asked (see Q&A 45) about the sources of information available for designing the communication plan you replied “Observatory Annual reports as well as minutes of working groups and plenary meetings are also useful background strategic and operational information. We understand that an important meeting of the Observatory’s Public Awareness Working Group took place between 3 and 5 May 2017. We understand that this information is crucial for designing a state-of-the-art and up-to-date communication plan. We understand that this information is not yet available on the website. We understand that the incumbent contractor (P.A.U. Education S.L.) attended that meeting (as it did all previous meetings) and has had access to that information. We are very concerned that this situation gives the incumbent contractor an unfair advantage over other companies and that this breaks the rule of equal treatment between all tenderers. Could you confirm that the minutes of that meeting will be published before the submission deadline for offers and that it will be published far enough in advance of the deadline so that tenderers will have enough time to adapt their communication plan accordingly?

In order to ensure transparency and equal treatment towards prospective tenderers, the Office agrees on disclosing the draft minutes of the working groups, for information purposes. These are published in the document library on the eTendering platform. It must be noted, however, that the Contracting Authority considers that the tender documentation, together with the online material, provides an exhaustive set of all information needed for the preparation of the tender; therefore the incumbent contractor does not have any competitive advantage.
