What is the process if a product predefined in Appendix 3 (Product Catalogue) becomes End of Life before the Submission date?

Since there is no dedicated "Comments" field/column in the Product Catalogue, the tenderers can add their comments concerning end-of-life products (if any, and clearly identifying the concerned part numbers) in a separate document, as an annex to the Product Catalog.

The tenderer must quote the unit prices for all the items in the product catalogue. Failure to do so may lead to the rejection of your tender. Please note that the EIB has uploaded on eTendering a revised version of the Product Catalogue, replacing or deleting the part numbers which became end-of-life since the initial publication of the procurement documents. If despite this a product becomes end-of-life in the period between the deadline for submission of questions and the deadline for submission of tenders, the tenderer should clearly mark those products in the Product Catalogue (in the comments field, which has been added to the revised version of the Product Catalogue). In the event of tenderers marking products as end-of-life, the EIB will check and validate this with the product manufacturer. If it is confirmed by the product manufacturer that a product is indeed end-of-life, this product will be excluded from the Product Catalogue for all tenderers and its price will not be taken into account for the financial evaluation. If it is not confirmed by the product manufacturer that the product is end-of-life, the missing unit prices of the respective positions in the Product Catalogue as offered by the tenderer shall be completed by the EIB for evaluation purposes with the following price: Product manufacturer's list price x 2. This mechanism will be used only in the event of tenderers explicitly marking products end of life. Missing prices in the Product Catalogue for reasons other than end-of-life may lead to the rejection of the tender.
