“Tenderers are required to identify all subcontractors. What do you mean by “subcontractors”? Do you include on these freelancers or only companies with whom we work?

Generally speaking, free-lance experts and contractors' suppliers are included in the "subcontractors" definition. Any third party involved in the contract implementation that has no legal link with ESMA but with the tenderer will be considered as subcontractor. However, involvement in contract implementation means participation in provision of services as specified in Section 2.3.2 of the tender specifications; if free-lance experts participate only in creation of new courses and their modification, they are not seen as subcontractors.
