7.1. Liquidated Damages Case 2
In section 4. General Configuration, capabilities and operational needs of VTOL Emissions Monitoring – Initial Configuration Test states that “To test the successful integration the device has to be mounted and fully integrated on the VTOL platform offered. Live emissions measurements on vessel(s) shall also be taken to demonstrate the readiness of the whole platform.”. However in section 7.1. Liquidated Damages of Tender specifications Attached to the Invitation to tender states that “Case 2: In Lot 1 (Emissions Monitoring) the contractor may request to perform the initial configuration test for the first RPAS without yet having the emissions sensor integrated with the RPAS platform proposed in the bid.” 7.1. Liquidated Damages Case 2 gives unfair advantage to vendors that are unable to integrate the sensor on time. We therefore suggest you either remove the option to conduct the Initial Configuration test without the emission sensors being fully integrated or set the Initial Configuration test at T0 + 45 + 3 months to all bidders upfront to allow a level playing field.

'For Lot 1, "Emissions Monitoring", the awarded tenderer may choose to perform the initial configuration test within 45 days from award (refer to Point 14.5.3 and Point 17 of the Tender Specifications) in non-integrated conditions (as specified in table "Emissions Measurement" of Appendix 2 of the Tender Specifications), even if the emissions sensor is already integrated in the RPAS platform proposed in the bid. The reason for such a flexibility was to take into account the difficulty involved in the organisation of a test for emissions monitoring within 45 days from award. In any case, the awarded tenderer will have to perform the initial configuration test with the sensor integrated within 3 months of signature of the Framework Contract. In case this deadline is not respected, Case 2 of "Liquidated Damages" under Point 7.1 of the Tender Specifications applies.
