We note the fact that this contract is open only to companies established in EU/EEA and GPA countries - however as the target of the work to be delivered under the contract relates to Eastern Partnership Countries, could you clarify if entities legally registered in EaP can formally take part in this contract?

As stated in Annex I – Tender Specifications in section 4.1 - Eligibility, this call for tenders is open to all natural and legal persons from one of the 33 EEA member countries and to all natural and legal persons established in a third country which has a special agreement with the European Union in the field of procurement on the conditions laid down in that agreement. As proof of eligibility tenderers must indicate in the tender submission form (see Annex 1 to the Tender Specifications) in which country they have their headquarters, registered office or residence, and provide the necessary supporting documents in accordance with their national law. Without prejudice to the above, a tenderer may, where appropriate and for a particular contract, rely on the capacities of other entities, regardless of the legal nature of the links which it has with them. In case of a joint offer by a consortium of entities, all members must fulfil the eligibility criteria; the participation of ineligible natural or legal persons will result in the automatic exclusion of that person.
