Handover
In Tender Specifications, in the table in p. 32, in the row concerning “New Software under reopening of competition” we read: “In order to ensure a fair and transparent evaluation of the New Software offers prior to the Specific Contract, ECDC will always order a Handover regardless which contractor is awarded the Specific Contract. If the Maintenance Contractor is also developing the New Software, then they have a competitive advantage that should impact the pricing.” Our understanding is that the Maintenance Contractor must also include in its offer a full handover, as if handing over to another contractor. However, the aim is only to ensure a fair competition. If the Maintenance Contractor wins the reopen, the Maintenance Contractor will not actually execute the handover (for example from its development to its own maintenance team). Please confirm our understanding.

In regards to “2.3.6 Work stream: Handover”, section “i. Products developed under the New Software work stream with reopening of competition.”, the sub-scenario “New Software under reopening of competition” with conditions “In order to ensure a fair and transparent evaluation of the New Software offers prior to the Specific Contract, ECDC will always order a Handover regardless which contractor is awarded the Specific Contract. If the Maintenance Contractor is also developing the New Software, then they have a competitive advantage that should impact the pricing.”, in case the Maintenance Contractor wins the reopening, it is assumed that the work performed under the Handover work stream will either require certain effort in case this was not done by the “core service delivery team” or no work at all in case the work was performed by the “core service delivery team”. Still, in both cases it is assumed that the Handover effort would be less than in case when the work was performed by another Contractor. Please see also the answer to question 77.
