2.5.2 IMPLEMENTATION OF THE CONTRACT si chiede di modificare il seguente inciso nella parte in cui prevede il periodo di prova in 5 gg “The Contractor shall present to EASO, at the very least, the CVs of one (1) to three (3) candidates whose profiles match the requirements, within five (5) working days from the date of the request. The Contractor must ensure that the proposed interim staff possesses the necessary professional qualifications for the duties to be carried out.” Ed infatti ai sensi dell’art. 33 del CCNL delle Agenzie per il Lavoro “Il periodo di prova è determinato in 1 giorno di effettiva prestazione per ogni quindici giorni di calendario a partire dall’inizio della missione. 4. In ogni caso il periodo di prova non può essere inferiore a 1 giorno e superiore a 11 per missioni fino a 6 mesi nonché a 13 per quelle superiori a 6 mesi ed inferiori a 12 e 30 giorni di calendario nel caso di missioni che prevedano un contratto di assunzione pari o superiore a 12 mesi. Resta inteso che per le missioni di durata inferiore a 15 giorni può essere stabilito un solo giorno di prova. Le frazioni inferiori a 15 giorni si arrotondano all’unità superior” 3.3.3.3. Evidence of the technical and professional capacity of the tenderer(s) è previsto che “References of 3 similar contracts in the last three years (similar shall be deemed to be a contract involving placement, within a given year, of at least 50 interim staff for periods of over 1 month each).  si chiede di chiarire Se per ultimi tre anni si intenda 2015-2016-2017 e se i tre clienti debbano per ogni anno aver avuto almeno 50 lavoratori temporanei per più di un mese

Trial period of five (5) working days is in line with the relevant collective labour agreement, in consideration of usual request to deploy interim for 3 months. Otherwise, for missions more than 3 months, trial period will be in line with the applicable legislation mentioned in art. 1.4.1. par. 3 in Technical specifications, in particular art. 33 CCNL and foreseen in the contract between Contractor and interim worker as established in art. 33 par. 2 CCNL. The period can be covered by 2015/2016/2017 or 2016/2017/2018. Yes the provision 3.3.3.3. shall be read as: References of 3 similar contracts, each for a period over 1 month, in the last three years (similar shall be deemed to be a contract involving placement within a given year, of at least 50 interim staff in a month).
