Many suppliers servers are located in EEA but some sub processors may store the data in third countries, therefore we request the following change: (b) The localisation of and access to the personal data processed by the contractor shall comply with the following : i. the personal data shall only be processed within the territory of the European Union and the European Economic Area; ii. the data shall only be held in data centres located with the territory of the European Union and the European Economic Area; iii. if access shall be given to such data outside of the European Union and the European Economic Area Contractor shall have in place appropriate safeguards as defined in the GDPR;

To the extent that personal data is going to be processed by the future contractor on behalf of the Agency, the provisions of Articles I.10 and II.5 of the draft contract will apply. Please note that, if part or all of the processing of personal data is subcontracted to a third party, the contractor shall pass on these obligations in writing to those parties, including subcontractors. The future contractor will not be able to change the location of data processing without the prior written authorisation of the Agency and on sound legal basis. As stipulated in section 1.7 of the tender specifications, any limitation, amendment or denial of the terms of the contract will lead to the automatic exclusion from the procurement procedure.
