Liability and insurance
The paragraph in the draft contract regarding liability and applicable law leaves us with a number of questions: 1) Is it required, that the tenderer takes an external insurance policy, or can the tenderer chose to bear the risk within the organization? 2) In case of a consortium, should the insurance policy cover all parties and also possible sub-contractors? Or just the lead partner? 3) It is a bit unclear which type of insurance is meant; Is it liability-insurance regarding possible damage on third party and IPR? Which types of damages should be covered and what should be the insured amount? 4) Working under Belgian law, does it require a Belgian insurance company or could it be from another EU country? 5) Does it cover direct and indirect damage? The replies to your questions could be found in Art.II.6.2 1) If required by the relevant applicable legislation, the contractor must take out an insurance policy against risks and damage or loss relating to the performance of the contract. It must also take out supplementary insurance as reasonably required by standard practice in the industry. Upon request, the contractor must provide evidence of insurance coverage to the contracting authority. 2) If taken, the insurance applies to each member of the group individually (group leader and members of the group – not applicable to subcontractors, other entities). 3) Professional risk indemnity insurance 4) You are free to choose any insurance company located within or outside of Belgium 5) Please see in this respect the relevant provision of the draft contract: II.6.3, II.6.4, II.6.5.
