1/ UK Partners or subcontractors
In case of hard Brexit, could partners based in UK a) be part of a Consortium led by a company based outside UK? b) be subcontractors? Thanks for your answer. Best wishes,

The following (point 1.3 in the tender specifications) applies to all consortium members, not to subcontractors: For tenderers, including their consortium partners in case of a consortium submission, established in the United Kingdom (UK): please be aware that after the UK's withdrawal from the EU, the rules of access to EU procurement procedures of economic operators established in third countries will apply to tenderers from the UK depending on the outcome of the negotiations. In case such access is not provided by legal provisions in force tenderers from the UK could be rejected from the procurement procedure. This requirement will not apply if the partners are subcontractors from the UK.
