Subcontracting
As stated, freelance interpreters/cultural experts are considered subcontractors. Can you please specify which declarations/documents we shall provide for each subcontractor (as a natural person, thus for each interpreter/cultural expert) at the tender stage? The limit of 30% has to be intended with reference to subcontracting in general? Only subcontractors who are legal persons and whose particular share of the global volume is above 30% of the total shall meet the exclusion criteria and only with reference to these subcontractors tenderers are asked to provide the documentation that defines role, activities, volume of subcontracting, statement of intent?

Subcontracting is the situation where the Contractor in order to implement the contract, enters into legal commitments with other legal or natural persons for performing part of the service (in particular, any work performed by a person who is not an employee of the tenderer will be considered as subcontracted). All subcontractors envisaged to put their resources at the disposal of the Tenderer for the performance of the contract shall meet the exclusion criteria given in section 3.1 of the Tender Specifications evidenced by the declaration on their Tenderer’s Declaration of Honour) excluding them from the participation in this tender as well as shall present duly signed and dated Statement of Intent (Annex VII) by each subcontractor stating its intention to collaborate when the contract is signed. The successful Tenderer shall submit the above mentioned documentation before the signature of the contract. If subcontracting is envisaged in the tender for a part equal or above 30% of the contract, the tender shall include during the submission phase, apart from the declaration on their honour of that subcontractor, duly signed and dated (Annex V – Tenderer’s Declaration of Honour), a complete documentation that: a) defines clearly the roles, activities and responsibilities of subcontractor(s); b) specifies the volume/proportion of the tender being subcontracted for each subcontractor; and c) contains a Statement of Intent (Annex VII) by each subcontractor stating its intention to collaborate in case the contract is awarded.
