Working hours
As per art. 4.2 of T.o.R, a working day is equivalent to 8 hours. Could you specify whether 8 hours/day will always be guaranteed and paid by FRONTEX also in case of shorter daily deployments (e.g. 6 or 7 hours/day)?; In this case, can you please clarify why tenderers are asked to quote only half-day deployments? Is there a minimum - maximum lenght as regards the working day?

As per article 11 of the Terms of Reference, working day shall be paid at the price of half day fee up to 4 hours per day and the hourly price for each hour beyond 4 hours. The Tenderers are asked to quote a price per Unit for Interpretation/Cultural Expertise Services for Half Day up to a maximum of 4 hours and a price for 1 Hour beyond 4 hours. In accordance with the Terms of Reference, a flexibility (24/7) with regards to working hours as well as places of performance of services will be asked from the deployed persons. The payment of the price will be calculated for each day based on timesheet signed by the interpreter/cultural expert and the Frontex representative. In accordance with the Terms of Reference, the exact time schedule may vary and may be adjusted according to the operational needs, situation and to the local arrangements. However, the Contractor is required to comply with the minimum safety and health requirements for the organisation of the working time (DIRECTIVE 2003/88/EC OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 4 November 2003 concerning certain aspects of the organization of working time). The estimated working hours will be indicated in a Request for Services and a Specific Order. The Contractor is obliged to comply with the requirements of the working conditions and monitor the working hours of the interpreter/cultural expert. In cases where there might be a risk of an extensive overtime, the cases should be immediately reported to Frontex and corrective measures should be implemented.
