Conflict of interest?
In relation to the submission of tenders for this framework contract, including the case studies under both lots, could you provide clarification on the rules regarding potential conflicts of interest? For instance, various members of our team are representatives on certain Commission expert groups related, in particular, to the topics of the case studies. Does this constitute a conflict of interest?

According to the Financial Regulation (Regulation (EU, Euratom) 2018/1046), the notion of a ‘conflict of interests’ should be solely used for cases where a person or entity with responsibilities for budget implementation, audit or control, or an official or an agent of a Union institution or national authorities at any level, is in such a situation. There are specific situations for economic operators, which qualify as "grave professional misconduct" and not as conflict of interests, e.g.: - where the operator attempts to unduly influence the decision-making of the contracting authority during a procurement procedure; - where the operator enters into agreement with other operators in order to distort competition; - where the operator tries to obtain confidential information that may give it undue advantages in the procedure. These cases are listed in Article 136(1) (c) FR and are a basis for exclusion of the operator.
