f) Broken windows; - does this risk refer to tenant’s liability only or should we consider it to be broader? In what way? g) Machinery breakdown; - how does this requirement refer to Frontex liability? Can you please give an example of a loss scenario, when Frontex might be liable for machinery breakdown? h) Atmospheric conditions (rain, etc.); - In vast majority of circumstances atmospheric conditions are usually considered to be Force Majeure / act of god, being the liability exclusion under variety of legal systems, including Polish civil law. How does this requirement refer to Frontex liability? i) Storms (incl. Lightning strike), flood, earthquake (incl. landslide) and other extreme weather conditions. - In vast majority of circumstances atmospheric conditions are usually considered to be Force Majeure / act of god, being the liability exclusion under variety of legal systems, including Polish civil law. f) - i) Detailed insurance coverage and exclusions will be specified during contract implementation via Specific Orders. The aim of this tender procedure is to chose an insurance broker with experience, expertise and capacity to act as an intermediary between Frontex and the insurance market. The future Contractor shall identify risks to be cover via insurance policies. Please consider the variability of the conditions in which Frontex operates e.g. accompanying into a container of unaccompanied minors for indentification reasons.
