Request for clarification about Professional Conflicting Interest
Dear Sir / Madam, A the end of Annex I from Invitation to Tender (Procurement Documents Part I), the § 7 "declaration" provides requirements for "Professional Conflicting Interest". Can you clarify these requirements ? Particularly on the following : Can an OEM involved in certification and CAW processes be eligible to this call for tender ? Thank you for your help. Best Regards

§ 7 "Declaration" of Annex I of the Tender Specifications (Procurement Documents Part II) is quite clear on the type of assurance of absence of “Professional Conflicting Interest” required from the tenderers. This, however, does not automatically exclude “an OEM involved in certification and CAW processes” as per your question. The way especially the technical part of the tender will be presented by the tenderer and how it corresponds to the requirements set forth in the tender specifications will to a large extent determine whether an OEM is in the situation of “Professional Conflicting Interest”. Consequently, a tender including an OEM will not per se be excluded, provided that the OEM can demonstrate that appropriate measures are taken to avoid any actual or potential “Professional Conflicting Interest” or any perception thereof. Such measures might, for example, include: submitting the tender as part of a joint tender where the OEM has no sole decision-making powers, putting in place safeguards that ensure a clear separation between the services/research activities covered by the tender, including the personnel involved therein, and the activities of the OEM as holder of an EASA certificate/approval (i.e. TC, DOA, POA, etc.) under Regulation (EU) 2018/1139 and related Implementing Rules, as well as further suitable measures foreseen by the tenderer.
