Note 3 CAO Particuliere Beveiliging Do we understand correctly that only CAO Particuliere Beveiliging applies?

Europol's understanding is that in the Netherlands there are two Collective Labour Agreements (CAOs) that are relevant for the type of services required by Europol. These CAOs are listed at Note 3 on page 13 of Annex 2 Technical_specifications, i.e.: - CAO Particuliere Beveiliging (1 July 2018 - 30 June 2023), declared mandatory applicable (AVV – “algemeen verbindend verklaard”) - CAO Veiligheidsdomein (1 October 2019 – 1 October 2021), applicable (by exception from the normal mandatory applicability under the AVV) only to the parties by which it was entered into. Which CAO is applicable to a particulat tender depends on its factual situation, i.e. if they are a party to the CAO Veiligheidsdomein (in which case this is the CAO applicable to them) or not (in which case the CAO Particuliere Beveiliging is applicable to them). Since this is a matter of Dutch labour conditions and factual situation, Europol cannot make the assessment for the tenderers. Tenderers are invited to make their own assessment.
