Question related to the answers given Q32 and Q39 Expert advice vs responsibility on projects vs T&M client references

Q32 the contracting authority answered that related to lot 3 criterion 3 'The provider is not in charge of the transition from SAP HR to Successfactors but will provide expert advice to “AAA” in the design and implementation of the new module. Whereas related on Q39 the contracting authority answered that ‘Isolated T&M requests do not necessarily demonstrate the tenderer’s ability to deliver the project, since the responsibility for the product delivery could theoretically still remain with the contracting authority. This implies in our humble opinion a contradiction. On the one hand it is stated the responsibility to deliver a project (transition) lays not with the provider moreover only expert advice will be requested whereas on the other hand T&M client references cannot be considered. Expert advice is usually offered in a T&M modus operandi. Hence a T&M client reference should be accepted as a proof of technical and professional capacity as longs as the client reference demonstrate and covers similar service lines, technologies and profiles. We do not see any referral to responsibility. Thank you to confirm that T&M client references are accepted as proof of technical and professional capacity as long as the client reference demonstrate and covers similar service lines, technologies and profiles.

The client references should demonstrate the tenderer’s ability to deliver whilst responsible for delivery. For this reason, it is required that these relate to Fixed Price or Quoted Time and Means mode of delivery for this reason. References relating to Time and Means delivery in that case would not be accepted. This would not prevent the contracting authority from requesting T&M resources in some circumstances and if required.
