MEO – SERVIÇOS DE COMUNICAÇÕES E MULTIMÉDIA, S.A., hereinafter also referred to as “MEO”, a public limited company, headquartered in Lisbon, at Avenida Fontes Pereira de Melo, nº 40, 1069-300 in Lisbon, registration number and tax identification number 504615947, registered in the Commercial Registry of Lisbon, with the current share capital of 10.000,000.00 Euros, hereinafter the “Applicant”. Having become aware of the details of the procedure for this tender, the Applicant, comes to, under the terms and for the purposes of article 21º of the DIRECTIVE 2014/24/EU OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 26 February 2014 , on public procurement, of article 66º and following of Decree-Law no. 18/2008, of 29 January, which approved the Public Procurement Code, as amended by Decree - Law no. 111-B / 2017 of August 31 and article 13 of the Code of Administrative Procedure approved by Decree - Law No. 4/2015 of January 7 (CPA), requests the confidentiality of part of the documents included in the proposal, specifically those indicated in the document Tender Specifications, 16. Award Criteria (1. Quality criterion 1 – Quality of the proposed collocation /hosting facility), on the following grounds:

"As a general obligation stemming from the Treaty on the Functioning of the European Union and the Charter of Fundamental Rights of the European Union, documents provided by the bidders in the context of a procurement procedure shall be treated confidentially as stated in the Invitation to tender EMSA/OP/6/2020 (point 17). In that respect, be informed that during the evaluation process bids are available only to the persons responsible for the evaluation, which are bound by a general obligation of confidentially and absence of conflict of interest. When submitting your offer, you are requested to clearly identify any parts containing confidential aspects, including, but not limited to, commercial or business secrets and they bill be treated accordingly when applicable (e.g. in case of requests of access to document from third parties according to Regulation (EC) 1049/2001 and requests for additional information on the successful bidder from unsuccessful bidders)."
