Is the assumption correct that this list regarding pre-existing rights is only provided when the specific agreement entails vesting the IP rights in EMA (as described in II.13.1.)?

Specific contract may include some detailed provisions on the IP rights, however the rules on vesting the IP rights are provided already in the framework contract. To that effect please see clause II.13 of the draft framework contract. The contractor is obliged to provide the list of all pre-existing rights to the results of this FWC or parts thereof, including identification of the rights’ owners (or the declaration that there are no pre-existing rights) to the contracting authority together with the invoice for payment of the balance at the latest.
