Question
The Bidder asks to change the clauses in Section II.24 of Service Contract to the following: The contracting authority and the European Anti-Fraud Office may check or require an audit on the performance of the contract. This may be carried out either by OLAF’s own staff or by any outside body authorised to do so on its behalf, unless that body is a direct competitor of the contractor. Such checks and audits may be initiated at any moment during the performance of the contract. The audit procedure is initiated on the date of receipt of the relevant letter sent by the contracting authority. Audits are carried out on a confidential basis. Such checks and audits shall be limited to the contractor’s answering questions put by the contracting authority (a maximum of once a year) about the contractor’s compliance with applicable law or this contract and, where necessary, the contracting authority being allowed to interview the contractor’s employee at the contractor’s premise. Having regard to the contractor’s duty of confidentiality towards other clients, the contracting authority accepts and acknowledges that the contractor shall not allow the contracting authority or an auditor mandated by the contracting authority to access its IT systems and/or its IT infrastructure.
