Reliance on our sister companies/subsidiaries to fulfil the professional selection criteria
Regarding your answer to question 3, we would like to request further clarification. We fall under the exceptional situations which, from our experience with past European Commission tenders, are not considered subcontracting: a) the use of workers posted to the contractor by another company owned by the same group and established in a Member State (“intra-group posting” as defined by Article 1, 3, (b) of Directive 96/71/EC concerning the posting of workers in the framework of the provision of services) and c) the use of workers temporarily transferred to the contractor from an undertaking established outside the territory of a Member State and that belongs to the same group (“intra-corporate transfer” as defined by Article 3, (b) of Directive 2014/66/EU on the conditions of entry and residence of third-country nationals in the framework of an intra-corporate transfer). Considering this, could you please clarify how we should identify our sister companies/subsidiaries (belonging to the same group) contributing CVs to this tender (intra-group posting)?

Considering that you will rely on the technical and professional capacity of sister companies/subsidiaries belonging to the same group they shall sign Annex 5.2, which needs to be customised replacing “to rely on its financial and economic capacity” by “to rely on its technical and professional capacity”. A duly signed declaration on honour will be also required as well as a clear indication of the specific capacities (and supporting evidence) that the sister companies/subsidiaries are contributing towards the fulfilment of the selection criteria.
