Declaration on honour
Regarding you reply to Q175 we would like to require an additional clarification. In Q82, concerning sister companies that fall within the exceptions a) and c) in section 2.4, you reply ‘You do not, thus, need to identify these sister companies as “subcontractors”, nor as “supporting entities” if you rely on them for the fulfilment of technical and professional selection criteria’. By not identifying these entities, we understand that neither the Letter of commitment nor the Declaration of Honour is needed. This is the approach other Commission services have applied when falling into this exception. If the technical and professional capacity of these sister companies are to be considered as capacity of the main tenderer, we do not believe further administrative documents should be asked from them, as they are neither subcontractors, nor entities on whose capacity is being relied (the 2 scenarios in the checklist for documents provided) Furthermore, the reply to Q77 which was asking whether a declaration on Honour is needed, your reply states “At tender time it is only necessary to provide a "commitment letter" for the relied upon entity”. Even though this question does not relates to sister companies that fall within exceptions a) and c), it still confirms that Declaration on Honour is not needed. Could you please confirm whether for exceptions a) and c), Declaration on Honour is exempt?

QA-200: The context of your question is not clear to us. Do you refer to the usage of exceptions a) and c) in section 2.4 for tender submission purposes, i.e. for the establishment of technical and professional capacity of the selection criteria, or to execution time? In the 1st case, you must provide a Declaration on Honour, as explained in QA-175. In the 2nd case, you do not need to provide a Declaration on Honour. You are welcome. Best regards
