Eligibility Under EASO-Switzerland Bilateral Cooperation Agreement (EASO/2020/830)
Question
The EASO -Switzerland bilateral agreement entered into force on 1 March 2016. This treaty inter alia allows Switzerland to participate in EASO's work and to receive support from EASO. The treaty also allows Swiss national experts to be engaged by EASO and deployed in EASO operations. Does this treaty qualify a Swiss entity to participate as a sole or lead tenderer in this call for tenders?

In line with the revised tender specifications part 1, point 2.2. Rules on access to procurement, please note that this procurement procedure is open to: 1. all natural and legal persons coming within the scope of the Treaties (i.e. established in the EU); 2. economic operators established in North Macedonia, Albania, Montenegro, Serbia, Bosnia and Herzegovina and Kosovo under the Stabilisation and Association Agreements (SAA); 3. Iceland, Norway and Liechtenstein (under the European Economic Agreement). This procurement procedure is not open to the countries parties to the Agreement on Government Procurement (except Iceland, Norway and Liechtenstein), i.e. it is not open to economic operators established in Switzerland. The rules of access to the market apply to a sole tenderer and to all joint tenderers, including lead tenderer, but do not apply to subcontractors.
