Exclusivity between Lots
With reference to Lots - exclusivity, as well as your responses to QAs# 41, 43, 136, 149, can you please elaborate further on the below points? We would highly appreciate it if you could provide further clarifications instead of referring us to your previous responses. 1. The exclusivity between Lots is based on fact that the Contractor of one Lot (e.g. Lot 1) may be requested to perform peer reviews (e.g. quality control) over the services provided by the Contractor of the second Lot (e.g. Lot 2) and vice versa. Could you please confirm that our understanding is correct? If not, please clarify in detail the list of services to be provided by the Contractor of one of the conflicting Lots that may raise a conflict with regards to the services provided by the Contractor of the other exclusive lot. 2. Taking into account that two conflicting Lots have exactly the same Scope of Services (the only differentiation being the location of the onsite services only while for the nearsite and offsite services there is not any differentiation), we kindly request that you specify in detail the process that will be followed for the request of the said services between Lot 1 and Lot 2 and between Lot 3 and Lot 4. For example, and in relation to Lot 1 and Lot 2 (similarly for Lot 3 and Lot 4), how the Contracting Authority will select the Lot to order the services foreseen for the “Core business systems”? Will specific Core Business Systems served exclusively under Lot 1 that will be different from the Core Business Systems served exclusively under Lot 2? If so, can you please define in detail the respective scope (in terms of different systems in scope of each lot)? Please provide us with detailed clarification on the distinction that will be applied in the scope of services between the conflicting lots taking into account the EU Procurement Regulations and procedures where the existence of more than one procurement channels for the procurement of the same services is not allowed.

1.: Indeed, as stated in section 4 of the Tender specifications, a contractor in lot 1 might be requested, for example, to perform a review relating to a service provided by a contractor in lot 2. 2.: The ordering process is described in section 3 of the Service Requirements document. For each specific contract envisaged, the selection of the lot will be determined by the localisation of the IT services in charge (unit/service) and the end users of the deliverables.
