Answer

(1)As indicated under article 3.3 submission of a tender implies acceptance of the terms and conditions set out in this invitation to tender, in the tender specification and in the draft contract and, where appropriate, waiver of the tenderer's own general or specific terms and conditions. (2)Hereby is meant that the tenderer's offer should comply with the tasks/terms and conditions set out in the invitation to tender, in the tendering specifications and in the draft contract. “Variant” means a solution technically or economically equivalent to a model solution described by the contracting authority. Variants may relate to the whole contract or to certain parts or aspects of it.
