I would be grateful if you could clarify the statement in Section 2.4 of tender specifications (part 2) that the Contractor will have access to "The sources of evidence on which the part on future competition of the evaluated decision was based and any other useful non-confidential information which can be shared with the Contractor"? In particular, I would like to understand whether the Contractor would have access to any confidential information during contract performance at all (e.g., confidential version of merger decision, evidence in the case file etc.)?

The Contractor would have the opportunity to interview the relevant case team on the sources of evidence on which the part on future competition of the evaluated decision was based and be given access to any other useful non-confidential information that can be shared with the Contractor. Moreover, the Commission services would, within the limits set by the principle of professional secrecy and the protection of personal data and business secrets, endeavour to make available to the Contractor the confidential version of relevant decisions and, upon request, the relevant parts of documents contained in its case file.
